| US Court of Federal Claims determines that CERCLA costs arising from operations under a terminated cost reimbursable contract may be claimed provided that the indemnification meets the requirements of the Anti-Deficiency Act (ADA). In du Pont, the language clearly intended a broad indemnification, but the court reluctantly found that the ADA barred the claim. Nonetheless, the Court found the claim sufficiently meritorius that it recommended that application be made to the Congress under 28 USC §§1492 and 2509 for relief. |
